Terms of Service
Effective January 1, 2026
Effective date: January 1, 2026. Customer acceptance records use the actual date and time of acceptance and are never backdated.
These Terms of Service ("Terms") are an agreement between ListSend, LLC, a North Carolina limited liability company ("ListSend," "we," "us"), and the business that creates a ListSend account ("Customer," "you"). By creating an account, purchasing a plan, or approving a campaign, you agree to these Terms, including the Refund & Cancellation provisions in Section 13. Our Privacy Policy is a notice explaining how we handle personal information; it is not a request for, or a substitute for, anyone's consent.
1. The Service
ListSend prepares and sends email campaigns for businesses to people who have given that business permission to receive its email. The service has three distinct stages:
- Preparation — you upload a contact list and campaign instructions; we prepare campaign content (subject lines, email text and design) and present it to you for review.
- Verification — we check uploaded addresses through a third-party email verification provider to identify invalid, risky, duplicate, or suppressed addresses.
- Sending — after you approve a campaign version and all sending requirements are met, we submit it to our email delivery provider for delivery to verified, eligible recipients, from a sender identity associated with your business.
ListSend is a campaign preparation and delivery service. It is not a list-building, lead-generation, or data-brokerage service, and we do not supply recipient lists.
2. Accounts and Authorized Representatives
You must provide accurate business and contact information and keep it current. The person who creates or uses the account represents that they are authorized to act for the business, including approving campaigns and making purchases. You are responsible for all activity under your account and for keeping sign-in credentials confidential. Tell us promptly at support@listsend.io if you believe your account has been accessed without authorization. Each account belongs to one business; you may not use one account to send on behalf of unrelated businesses.
3. Permission-Based Audiences Only
You may upload only contacts who have given your business permission to receive the kind of email you ask us to send. The existence of some other possible legal basis for sending is not enough; every contact must have given your business permission. You must also comply with the U.S. CAN-SPAM Act and any other laws that apply to you or your recipients.
You may not upload or ask us to email:
- purchased, rented, traded, scraped, harvested, or appended lists;
- addresses collected without disclosure that the person would receive email from you;
- people who have unsubscribed from, or asked not to receive, your email;
- role or distribution addresses you are not authorized to email.
On request you must tell us how and when contacts gave permission. We may decline, pause, or stop any campaign where we reasonably believe a list does not meet this section, or where bounce, complaint, or unsubscribe rates indicate a permission problem.
4. Your Content, Claims and Assets
You are responsible for the accuracy and lawfulness of everything you supply or approve, including offers, prices, claims, testimonials, logos, images, and trademarks, and for having the rights to use them. You must not ask us to send content that is false or misleading, infringes others' rights, is unlawful, or promotes prohibited goods or services. Content we prepare is based on your instructions; your approval confirms that the approved version is accurate and that you are permitted to send it. Commercial emails must include your business's valid physical mailing address and a working unsubscribe mechanism; sending is blocked until a mailing address is provided.
Published email assets are public by URL. Images used inside your emails (such as your logo) are published at a web address so they can display in recipients' mail apps. Anyone who has that address can view the image. Do not supply images that you would not want to be publicly viewable. Your recipient lists are never published and remain private.
5. Campaign Preparation, Approval and Revisions
- Each prepared campaign is saved as a numbered version. Only a version you approve can be sent.
- Approving a version does not by itself schedule or send it.
- If content changes after approval, the new version requires a fresh approval.
- You may request revisions before approval through your dashboard.
- Sending also depends on requirements outside the content itself: verified recipients, a ready and authenticated sender identity for your business, your mailing address, an active plan entitlement, and ListSend's own sending availability. A campaign may be delayed or not sent if any of these are not met, and we will show the outstanding requirement in your dashboard where possible.
- Open and click tracking is on by default. You may turn it off for a campaign before approving it; changing it after approval creates a new version that needs fresh approval. Delivery, bounce, complaint, and unsubscribe processing continue either way.
- You must keep your sending domain's authentication records in place while campaigns are sending.
6. Verification
Verification results reflect an address's status when it was checked. We save results and generally reuse them rather than checking the same address again within the same campaign. Address status can change over time, so we may re-verify addresses in later campaigns or after time has passed, and verification does not guarantee that an address will accept email. Verification is included in your plan price; any change to how verification is charged would be disclosed before purchase.
7. Plans, Prices and Limits
Prices are in U.S. dollars and exclude any applicable taxes.
One Blast — $199, one time. One single-email campaign to up to 5,000 verified, eligible recipients. It cannot be used for a multi-email sequence and is not combined with Monthly allowances.
Monthly — $299 per month. Up to 4 sends per billing period, where each email in a sequence counts as one send. Each campaign may reach up to 10,000 verified, eligible recipients. Sequences may contain up to 3 emails.
Contact add-ons — $10 per additional 1,000 recipients.
- One Blast: a one-time charge tied to that campaign.
- Monthly: $10 per month per 1,000, applying to each campaign under that subscription.
- Add-ons are sold in whole blocks of 1,000, rounded up. They increase recipient capacity only; they do not add sends.
- The required quantity and total are shown before payment. We never purchase add-ons automatically or charge for excess contacts without your checkout.
How recipients are counted. Limits apply to verified, eligible recipients per campaign — not all stored contacts. Duplicates, invalid addresses, held-out addresses, and suppressed contacts (for example unsubscribed, bounced, or complained addresses) are excluded.
Payments are processed by Stripe. A payment grants an entitlement to send; it does not by itself launch a campaign or bypass verification, approval, or sender requirements. Unused Monthly sends do not roll over to the next billing period.
8. Renewal and Cancellation
Monthly subscriptions renew automatically each billing period at the then-current price until cancelled. You can cancel at any time through Manage billing. Cancellation stops the next renewal; your Monthly entitlements continue until the end of the period already paid. Recurring contact add-ons end with their parent subscription. After a plan ends you keep ongoing dashboard access to historical campaigns and results, but sending new campaigns requires an active entitlement. Refunds are governed by Section 13. We will give advance notice of any price change for renewals.
9. Submission, Delivery and Inbox Placement
These are different things, and we report them separately:
- Submitted means our email delivery provider accepted the message for delivery. It does not mean the message reached the recipient.
- Delivered means the delivery provider reported that the recipient's mail server accepted the message. It does not mean the message reached the inbox.
- Inbox placement — whether a message lands in the inbox, a promotions tab, or spam — is decided by the recipient's mailbox provider. We do not control it, cannot confirm it, and do not guarantee it.
We do not guarantee sales, leads, revenue, replies, opens, clicks, or any other engagement. Reported delivery, open and click figures depend on provider data and recipient software and may be incomplete or inaccurate. A message already submitted to the delivery provider cannot necessarily be recalled, including after a campaign is paused.
10. Suspension and Termination
We may pause campaigns or suspend an account, with notice where practicable, if we reasonably believe you have breached these Terms, if your campaigns create legal, deliverability, or security risk (including elevated complaints or bounces), if required by law or a service provider, or for non-payment. You may stop using the service and cancel at any time. On termination for breach, unsent campaigns will not be sent. Sections that by their nature should survive survive termination.
11. Intellectual Property and Permissions
You keep ownership of your contacts, content, logos, and other materials. You grant ListSend a limited, non-exclusive, non-transferable permission to store, copy, format, publish (for email assets only, as described in Section 4), and transmit those materials, and to share them with our service providers, only as needed to provide the service, keep required records, and comply with law. Campaign content we prepare for you is yours to use once paid for. ListSend keeps all rights in its platform, software, templates, and brand; nothing in these Terms transfers them to you.
12. Changes to These Terms
We may update these Terms. We will post the new version with its effective date and notify customers of material changes in advance where practicable. New versions apply to purchases and campaign approvals made after they take effect; we may require acceptance of updated Terms before your next purchase.
13. Refund & Cancellation
These provisions explain cancellations and refunds for services provided by ListSend, LLC ("ListSend") and form part of these Terms.
13.1 Service Stages
A ListSend purchase is fulfilled in three distinct stages, and we record when each happens:
- Preparation — preparing campaign content and presenting a version for your approval.
- Verification — checking your uploaded addresses with our verification provider.
- Sending — submitting an approved campaign to our delivery provider for delivery to verified, eligible recipients.
A payment, an uploaded list, or a prepared campaign version on its own is not treated as proof that the whole service was delivered. When we assess a refund request we look at which stages were actually completed for that purchase.
13.2 Refunds
- Before any work begins — full refund. If you ask us to cancel a purchase before we have started preparation, verification, or sending for it, we will refund it in full.
- One Blast partial fulfillment — refund of the unperformed portion. For One Blast purchases where this allocation was shown before purchase, the $199 base price is allocated as follows: campaign preparation $50; list verification $25; sending $124. These are disclosed service-price allocations, not statements of ListSend's underlying costs. If you cancel after some stages are completed, we keep only the amounts allocated to completed stages and refund the rest. This allocation does not apply to purchases made before it was disclosed, and it does not apply to Monthly subscriptions or contact add-ons.
- Partially completed One Blast send. If sending has started but not finished, we keep the share of the $124 sending allocation that matches the unique recipients whose messages our delivery provider accepted, and refund the rest. The share is accepted unique recipients divided by the campaign's eligible audience recorded at launch. Each recipient counts once; retries do not increase the amount kept, and submissions the provider rejected do not count as accepted. Provider acceptance is not a guarantee of delivery or inbox placement. If the outcome of any submission is unknown, we reconcile it before calculating the final refund. The $50 preparation and $25 verification allocations still follow the completed-stage rule above. Example: 4,000 eligible recipients at launch, 1,000 accepted means we keep $50 + $25 + $31.00 and refund $93.00.
- One Blast contact add-ons. If a One Blast campaign is cancelled or only partly sent, unused add-on capacity is refunded per recipient. The included 5,000 recipients are counted first, then purchased add-on capacity. Used add-on recipients equal unique provider-accepted recipients minus 5,000, never below 0 and never more than the add-on capacity purchased. Refund equals add-on amount paid multiplied by unused add-on capacity divided by add-on capacity purchased, rounded to the nearest cent. If no add-on was purchased, the add-on refund is $0. A campaign sent to its entire approved audience receives no add-on refund merely because purchased 1,000-recipient blocks contain unused space.
- Monthly contact add-ons. Monthly add-ons follow the Monthly cancellation rule: cancellation stops renewal, with no prorated refund for unused time or capacity, except where required by law. Add-ons end with their parent subscription.
- Disclosure. These rules apply only to purchases where they were shown before purchase. We keep a record of the exact policy version and checkout disclosure shown for each purchase.
- Completed services. Once a campaign has been sent, we do not refund it merely because it did not produce the marketing results you wanted (such as sales, leads, opens, clicks, or inbox placement), except where a refund is required by law.
- Duplicate or unauthorized charges. If you believe you were charged twice for the same purchase, or a charge was not authorized by your business, contact us promptly. We will investigate and, once confirmed, correct the charge, including refunding the duplicate or unauthorized amount. Duplicate subscriptions are flagged for review rather than refunded automatically.
- Refunds, where granted, are returned to the original payment method through Stripe. Stripe's and your card issuer's processing timelines apply.
13.3 Monthly Cancellation
- You can cancel a Monthly subscription at any time through Manage billing. Cancellation stops the next renewal, and you keep Monthly entitlements until the end of the period already paid.
- We do not give prorated refunds for unused time or unused sends in a billing period, except where required by law.
- Recurring contact add-ons end with the parent Monthly subscription and are not billed independently afterwards.
13.4 Other Rules
- Historical campaigns and results remain accessible in your dashboard after a One Blast is used or a Monthly subscription ends. Sending new campaigns requires an active entitlement.
- No automatic charges for extra contacts. Add-ons are only charged when you complete checkout for them.
13.5 How to Request a Refund or Cancel
- Cancel a Monthly subscription at any time through Manage billing in your dashboard.
- For refund requests, email support@listsend.io from your account email with the purchase date and the reason.
- We aim to respond to refund requests within 2 business days. This is our response time, not the time a refund takes to arrive: once a refund is approved and issued through Stripe, it usually takes several more business days to reach your account, depending on your card issuer or bank.
If you open a payment dispute with your bank, we may provide records of the purchase, policy acceptance, and completed service stages to the payment processor.
